Terms & Conditions

Overview

In order to provide a large range of in-the-Workplace Incentives including Services and Activities, we utilise Vendors of specific products. In addition, we provide Products from vendors including physical goods and digital goods that are delivered or accessed as an incentive in-the-workplace.

An inherent requirement of any purchase of a Workplace Incentives Product, Activity or Service is that you have suitable spatial requirements for your purchase at a venue of your choice – usually your workplace. In having the incentive within your working environment you improve convenience, attendance, security, personal-safety and make the experience of the incentive more effective.

Workplace Incentives is a booking agent (“Agency”) for companies that provide Products, Activities and Services (“Vendors”) to individuals and groups in the corporate market (“Customers”). Workplace Incentives is not usually the provider (“Vendor”) of these Products, Activities and Services.  With the exception of Services offered internally and by the wholly owned 3 Minute Angels. Workplace Incentives is an agent only for suitable, insured and qualified Vendors.

Terms

1.     Making a Purchase

When the Customer (“You”) purchase and/or use Workplace Incentives Products, Services, tick the box that says 'I understand and accept the Terms and Conditions', you become legally bound by these terms and conditions. Please do not proceed to purchase/use your Workplace Incentives product or service until you have read, understood and accepted these terms and conditions. [TOP]

2.     Creating A Customer Account

When the Customer (“You”) says 'I understand and accept the Terms and Conditions' You agree to create a Customer Account for the purpose of purchasing your Product, Activity or Service.  Included in your Customer Account is the requirement for contact details, user names and passwords that allow you to return and purchase from the same Customer Account. 

Your Customer Account with Workplace Incentives is a credit only account.  In order for you to make a purchase you must have the means to pay online or have Credit applied to your Customer Account by the management of Workplace Incentives.

Your Customer Account is assigned to the Customer (“You”) alone. [TOP]

3.     Credits and Crediting Your Customer Account

Credits can be used to purchase any of the listed Workplace Incentives Products, Activities and Services.

Credits cannot be exchanged for cash, but can be used to purchase Workplace Incentives Products, Activities and Services.

Your Customer Account can receive credit in the following situations:

  • You determine to buy Credit
  • You are the rightful recipient of a Gift Certificate
  • You decide within our Exchange and Booking requirements to purchase an alternative product or lesser value than one you had already purchased
  • You cancel a booking and receive a refund in the form of Credit from Workplace Incentives
  • You have enacted the 110% Satisfaction Guarantee and Credit has been applied to your account by Workplace Incentives
  • You have been gifted as part of a promotion by Workplace Incentives a Credit. [TOP]

4.     Fit For Activities and Services

When the Customer (“You”) says 'I understand and accept the Terms and Conditions' You agree that the Participants are fit to participate in Activities and Services sold by Workplace Incentives and do not suffer from any Medical Condition and/or incapacity which may impair the Participants ability to participate in Workplace Incentives Activities and Services and further, that the Participant does not suffer from any Heart Condition, Epilepsy or other Medical Condition which may result in the Participant potentially placing himself/herself in a position of risk, by undertaking the booked Activity or Service. [TOP]

5.     Restrictions on Taking Activities

Certain Activities and Services provided by Vendors are subject to minimum age, weight, health or other restrictions. These restrictions are outlined on the relevant Important Information page in the Products Description.  Please read this information carefully. It is your responsibility to understand any restrictions prior to confirming your booking. If you are later forced to cancel due to restrictions, you may be liable for charges. [TOP]

6.     Activity Indemnity

The Customer (“You”) acknowledges that when You tick the box that says 'I understand and accept the Terms and Conditions', you acknowledge and agree to release Workplace Incentives from any liability, you acknowledge and agree to fully indemnify Workplace Incentives and all its servants, agent's, clients and employees against any injury, damage or accident that may be sustained by the Participant, whilst participating in Activities and/or Services booked through Workplace Incentives and the Entities and Groups who offer various services to Workplace Incentives. [TOP]

7.     Insurance

Workplace Incentives engage Vendors that have proven the necessary and relevant insurances are in place for the Product or Service in question.

Products that are delivered by Vendors to Customers are covered exclusively by the insurance policies of the Vendor. 

Workplace Incentives has no liability for the Products delivered by our Vendors.

Some of the Activities and Services that we promote as agent are considered dangerous. Prior to ordering or participating in any Activity or Service you should be aware of the risks involved.

Vendors warrant that they maintain appropriate Public Liability Insurance (and Professional Indemnity insurance where appropriate) for all risks associated with its business and service provisions. Workplace Incentives makes no warranty or representation about their business or services whatsoever.

The responsibility rests with you to make independent enquiries as to the need to acquire your own insurance cover. [TOP]

8.     Assignment of Professional Indemnity Risk

The Customer (“You”) acknowledges any information provided by the Vendor to Participants during an Activity or Service is on an “all care and no responsibility” basis.   Unconditional indemnity is provided to Workplace Incentives by the Customer for any actions or decisions made as a result of information received by an individual or group during an Activity or Service provided by Workplace Incentives. [TOP]

9.     Descriptions

Each Workplace Incentives Product, Service or Activity is described in a Product Description and is accompanied by Important information that relates to exclusions, parameters and requirements that the Customer is responsible for being familiar with prior to making a Booking.

We try to ensure that our promotional information is accurate and up-to-date. However, the content or format of some experiences may change slightly from time to time. [TOP]

10.  Suitable Venue

The Customer (“You”) acknowledges that Workplace Incentives Services and Activities are provided on the basis that Customer (“You”) you have a Suitable Venue to host the purchased Activity or Service.  The Spatial Requirements are clearly described in the Important Information contained within the Product Description of each item.

During the Booking Process you may provide an alternative venue to that of your actual office if you deem it a Suitable Venue.

Workplace Incentives will not accept the selection of an inappropriate venue by the Customer as a valid reason to honour any refund or credit, including, but not limited to the provision of the 110% Satisfaction Guarantee.

The responsibility rests with the Customer (“You”) to make independent enquiries as to the need to acquire your own insurance cover in order to host Activities or Services. [TOP]

11.  Alternative Venues

During the Booking Process you may provide an alternative venue to that of your actual office if you deem it a Suitable Venue.

Workplace Incentives work best in the workplace, however not all Customer workplaces are equipped to handle the Services and Activities.  Alternative venues could include hired space, space belonging to the same company in a different location or any customer-determined Suitable Venue. [TOP]

12.  Service and Activity Session Length (Duration)

Service and Activity session lengths are approximate and are given by Vendors as a guide to the total time they will be at your Suitable Venue. [TOP]

13.  Availability

All Activities and Services are offered by Vendors are subject to availability. Bookings should be made at least 3 weeks in advance. If you would like to book during peak times, you should book further in advance. Please be advised that some Products, Services and Activities display availability dates on the website. These dates are guidelines only and are subject to change. [TOP]

14.  Prices

Workplace Incentives reserves the right to change prices without notice. All displayed prices exclude Goods and Services Tax (GST) prior to checkout and the GST applied at the current rate of 10% in Australia is added to the purchase and included in your invoice and pre-invoice screens within the Booking Process.

All transactions carry a flat $3.50 fee. [TOP]

15.  Contact Details Given to Vendors

It is your responsibility as the Customer when creating your Customer Account and making your Booking to ensure you enter your email address, billing address, delivery address and other contact details correctly when you complete the Booking Process on a Workplace Incentives website. Failure to do so may result in loss or incorrect delivery.   The details you enter during the Booking Process will be used by Vendors to fulfil delivery of the Product, Service or Activity. [TOP]

16.  Bookings

Bookings made through Workplace Incentives are non-refundable in whole or in part (except in the case of enacting the 110% Satisfaction Guarantee) however you can apply any amount previously purchased as Credit to your Customer Account.  Your Customer Account is fully flexible and may be exchanged for or used towards another purchase. [TOP]

17.  Changing Your Mind

Changing your booking at any time will incur a $30 administration fee.

Changes to your booking require a minimum of 7 days written notice prior to the booked date. No changes are permitted within 7 days of the date of your booking.

As a Customer you can change your mind as long as we receive written notification prior to 7 days before your current booking.  Upon receipt of your request to change Booking Details, Workplace Incentives will convert your current balance to Credit and apply this Credit to your Customer Account.  This can then be applied to a purchase of lower or equal value immediately. 

If the subsequent purchase is for a higher amount then the Credit applied to your Customer Account then you will have to make up the difference when you complete the next (new) purchase. [TOP]

18.  Fewer Participants

If you have fewer Participants show at the booked time, or on the booked day for any Service or Activity, we cannot offer a refund or credit. [TOP]

19.  More Participants

As long as your booking does not exceed the maximum group size for the Service or Activity that you purchased you will not be charged for any additional people that attend a Service or Activity.

If however, the Service or Activity required Materials to be bought on-site by Workplace Incentives or our Representatives and Vendors then the quantum of Materials will be according to the Expected Participants provided during the Booking Process.

If there are more Participants present in an Activity or Service then is allowable according to the Maximum Group Size identified in the Booking Process then the Customer (“You”) agrees that you will be re-invoiced for any additional purchase(es) and payment for this subsequent purchase is required within 7-days of receipt of invoice. [TOP]

20.  Recording and Webcasting Activities and Services

Workplace Incentives allows the Customer to video or audio record any Activity or Service.

Workplace Incentives strictly prohibits the real-time relaying or web-casting of any Activity or Service.

Workplace Incentives and our Representatives and Vendors can at any time suspend a purchased Activity or Service if they suspect the Customer has web-cast or digitally transmitted this information to another individual or group. [TOP]

21.  Delivery

It is the responsibility of the purchaser to correctly address Products, Delivery location, Activities and Services, whether by email, post or courier. Workplace Incentives cannot be held responsible for any damaged, missing or delayed orders where incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided.

A redelivery charge will apply (depending on the delivery method chosen) if the item is lost after receipt, if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

Delivery via Email

Workplace Incentives is not liable or responsible for any loss suffered as a result of an information product or service via email being blocked by filters or firewalls, or where the incorrect email address has been entered by the purchaser.

If the recipient does not receive the email, please contact us immediately on 1300 66 20 22. Alternatively, we can change the delivery method, which would incur the normal delivery fee of that service.

Delivery via Standard Post

Standard Post delivery is via Australia Post. Workplace Incentives accepts no responsibility for any damage, loss or delay as a result of using Australia Post's service. If for any reason your Gift Voucher doesn’t arrive, please contact us immediately and we can arrange for the Gift Voucher emailed to you free of charge.

Delivery via Express Post

Express Post delivery is via Australia Post. Workplace Incentives accepts no responsibility for any damage, loss or delay as a result of using Australia Post's service. We can provide you with the Express Post tracking code to contact Australia Post in the event you need to locate the whereabouts of your delivery.

Australia Post only guarantees next day delivery to certain postcodes nationally. To view this list, please visit Australia Post 

A redelivery charge of $6 will apply if the item is lost after receipt, if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

Delivery via Courier

We use various contracted courier companies. Workplace Incentives accepts no responsibility for any damage, loss or delay as a result of using this service. Delivery charges are non-refundable.

A redelivery charge of $20 will apply if the item is lost after receipt, if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

Delivery of Direct Ship Items

Direct Ship items refers to Hampers, Flowers, Wine, Fruit and Movie Tickets.

It is the responsibility of the purchaser to correctly address gifts. Workplace Incentives cannot be held responsible for any damaged, missing or delayed orders where incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided.

It has been requested that the item be left unattended. [TOP]

22.  Guarantees

110% Satisfaction Guarantee – If you are unsatisfied with the Product, Activity or Service that was purchased you will be entitled to a refund in full plus 10% of the value of the purchase. 

We require written notification (by email, or post) of your desire to enact this guarantee within 48-hours of delivery of the Product, Activity or Service.  You will be contacted in-person by Workplace Incentives representatives across Australia to ensure the legitimacy of the complaint and to help you expedite payment from the Vendor. 

Payment will be made via EFT to the correctly nominated bank account or can be added to your Credit Balance.

Best Price and Price Match Guarantee - If you find the same Product, Activity or Service from our Vendor or equivalent Vendor providing exactly the same Product, Activity or Service, we’ll match any lower quoted price! All we require is a genuine quote from the lower priced competitor and we will match it. Simply call us or send an email.

Guarantees and Warranties required by law - Workplace Incentives complies with Australian Consumer Law in respect of guarantees and warranties for our products and services. In respect of Products it is our responsibility to ensure the products are of acceptable quality, free from defects and fit for the purpose considering the prices and description provided to you at the point of sale.

If the product does not fulfil any of these criteria or your expectations then we will consider a refund according to our 110% Satisfaction Guarantee or Credit equivalent to the 110% Satisfaction Guarantee.

In respect of  the Products, Activities and Services it is the independent Vendors who accepts responsibility for compliance with the Australian Consumer Law in respect of services, that is that the Product, Activity or Service was provided with due skill and care and complied with the description made to the Customer at the time of sale. Workplace Incentives is not usually the Vendor. [TOP]

23.  Cancellations

Any Cancellation within 7 to 3 days of the booking date and time will result in 50% refund of the booking value being added to your Customer Account as Credit.

Any Cancelation within 48 hours (2 days) of the booking date and time will result in a 25% refund of the booking value being added to your Customer Account as Credit.

Workplace Incentives and our Vendors reserve the right to cancel a Product, Service or Activity at any time for any reasonable and unforeseen circumstances. In such an event, an alternative date will be arranged with the Customer on behalf of Participants. No refund will be available.  Credit can be applied to the Customer Account.

In the event the activity is cancelled or postponed for any reason, the Customer agrees to reschedule another date or, where possible, exchange for another Workplace Incentives Product or Service. Bookings made through Workplace Incentives are non-refundable in whole or in part.   Credit can be applied to the Customer Account. [TOP]

24.  Complaints or Problems

If you have a problem or a complaint on the day of your experience, please bring this to the Vendors attention immediately so that issues may be addressed on the spot, where possible.

If you do not feel that the problem was sufficiently resolved please contact Workplace Incentives 1300 66 20 22 and we will try to resolve the issue.  If you still feel the issue remains unresolved or as caused the Purchase to be unsatisfactory then you should enact the Workplace Incentives 110% Satisfaction Guarantee. [TOP]

25.  Illustrations and Website

The photographs used on our websites to illustrate a Product, Service or Activity are provided to us by Vendors as an indication only of the experience. [TOP]

26.  Other Information

The text and illustrations (including photographs) used by Workplace Incentives are protected by copyright and must not be copied in whole or in part without the express permission of Workplace Incentives. [TOP]

27.  Right To Recourse

The Customer  (“You”) pledges that no legal action will be initiated by it against Workplace Incentives, its clients, its agents, employees, instructors, and/or personnel, due to any accident or injury sustained during the course of undertaking an Activity or Service booked through Workplace Incentives. [TOP]

28.  Workplace Incentives Legal Entities

The Workplace Incentives websites (www.WorkplaceIncentives.com.au ) and are owned and operated by Workplace Incentives Pty Ltd (ABN 66 138 781 423) herein referred to as "Workplace Incentives". We reserve the right to change these terms and conditions without notice. [TOP]
